Terms of Service

These Terms of Service (“Terms”) constitute a legally binding agreement between you (the “User”, “Customer”, or “You”) and OpenBird Solutions (“OpenBird”, “we”, “our”, or “us”), governing your access to and use of the OpenbirdAI website, web application, APIs, and associated workspace intelligence tools located at https://ai.openbird.site.

By creating an account, completing mandatory onboarding, connecting a business or social integration, or using OpenbirdAI, you acknowledge that you have read, understood, and agreed to be bound by these Terms, together with our Privacy Policy and User Data Deletion Instructions. If you do not agree to these Terms, you must not access or use the platform.

To use OpenbirdAI, you represent and warrant that:

• Age Requirement (18+): You are at least 18 years of age (or the age of legal majority in your jurisdiction). Users under 18 are legally restricted from accessing AI inference and workspace creation.
• Age declaration: During onboarding, you must declare that you are at least 18 and provide your country of residence. The age declaration is self-reported and is not independent proof or identity verification. Existing accounts may retain previously submitted, locked date-of-birth records.
• Authority: You have full power and authority to enter into these Terms on your own behalf or on behalf of the commercial entity you represent.
• Account Security: You are responsible for safeguarding your login credentials and two-factor authentication (TOTP/recovery codes). You must notify OpenBird Solutions immediately of any unauthorized account access.

OpenbirdAI is a unified business workspace, content intelligence, and operational orchestration suite powered by the OpenFeather Decision Engine. Core capabilities include:

OpenbirdAI interfaces with external third-party services via official APIs. By connecting your accounts, you agree to comply with their respective terms:

License to Operate: You grant OpenBird Solutions a limited, worldwide, non-exclusive license solely to process, cache, and display your data as necessary to provide the workspace services and generate analytics.

You agree to use OpenbirdAI responsibly. You agree NOT to:

Supervised Execution Standard: OpenbirdAI agents prepare recommendations and operational drafts. Consequential business actions (such as sending emails, publishing social media posts, or modifying accounts) require explicit user approval.

OpenbirdAI provides a Free Tier and premium paid access:

• Free Tier: Basic workspace access, 30 daily AI calls, 500 weekly credits, and OpenFeather Core model access.
• OpenbirdAI Flight (30-Day Pass): Premium access priced at **$29.00 USD** per 30-day period. Grants 300 daily AI calls, 5,000 monthly credits, 10 workspaces, and OpenFeather Pro/Reason models.
• No Hidden Auto-Renew: Flight is architected as a **30-Day Fixed Duration Access Pass** settled securely via PayPal Orders. Your account will not be charged on an unprompted negative-option cycle. When 30 days expire, your account gracefully returns to the Free Tier unless you affirmatively choose to purchase a renewal pass.
• Frictionless Cancellation: You may cancel or let your access expire at any time in Account Settings without cancellation fees.
• Refunds: Refund requests submitted within **7 calendar days** of initial purchase with a valid PayPal Order ID are evaluated under our fair-use refund policy.

OpenbirdAI relies on external APIs (Google, Meta, TikTok, DeepSeek, NVIDIA, PayPal). If an external provider experiences outages, revokes developer scopes, or changes platform policies, service availability may be temporarily affected. OpenBird Solutions is not liable for interruptions resulting from third-party outages.

PLEASE READ THIS SECTION CAREFULLY AS IT DEFINES THE EXTENT OF OUR LEGAL LIABILITY.

THE PLATFORM IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OPENBIRD SOLUTIONS DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

IN NO EVENT SHALL OPENBIRD SOLUTIONS, ITS OFFICERS, DIRECTORS, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES (INCLUDING LOSS OF PROFITS, BUSINESS REPUTATION, OR PLATFORM ACCOUNT SUSPENSION). OUR TOTAL AGGREGATE LIABILITY ARISING UNDER THESE TERMS SHALL NOT EXCEED THE TOTAL FEES PAID BY YOU TO OPENBIRD SOLUTIONS IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED US DOLLARS (USD $100.00), WHICHEVER IS GREATER.

You may terminate your account at any time using our self-service deletion workflow (/dashboard/settings?tab=danger).

OpenBird Solutions reserves the right to suspend or terminate accounts that violate these Terms, abuse rate limits, or engage in fraudulent activities, in accordance with applicable law.
